ACTIVATING THE ROLE OF THE VICTIM IN FORENSIC PSYCHOLOGICAL EXAMINATION: A NARRATIVE APPROACH TO THE PROBLEM OF COMPENSATION FOR MORAL SUFFERING

The article analyses the problem of expert methodology in determining the amount of moral damage. It examines the limitations of objectivist and formulaic approaches (in particular, the current expert methodology developed in the context of O. M. Erdelevsky’s approach), which, in their pursuit of standardization, negate the unique subjective experience of the victim. An in-depth analysis of the application of the narrative approach in forensic psychological examination to determine the amount of compensation for moral damage is presented. The optimization of this approach is justified by a detailed algorithm that provides for the active subjective role of the victim in formulating the requested amount and expert psychological justification of this amount using the improved criteria of V. P. Paliuk. The theoretical foundations, methodological aspects, potential challenges and advantages of the proposed model are considered.
