TACTICS OF USING SPECIAL KNOWLEDGE WHEN CARRYING OUT CERTAIN INVESTIGATIVE (SEARCH) ACTIONS

Abstract

The article examines the tactical features of using special knowledge during the conduct of individual investigative (detective) actions in criminal proceedings. It is emphasized that the effectiveness of a pre-trial investigation largely depends on the completeness and quality of collecting evidentiary information, which often requires the involvement of persons who have special knowledge in various fields of science, technology, art and craft. It is substantiated that the use of such knowledge contributes to a more effective search, fixation, seizure and preliminary assessment of traces of a criminal offense, and also ensures the use of modern technical means and methods of forensics. The work examines the importance of special knowledge at different stages of conducting investigative (detective) actions. It is determined that the need for their application may arise both at the stage of preparation for the relevant procedural action and directly during its implementation. At the preparatory stage, the tactical features of using special knowledge are associated with assessing the investigative situation, determining the expediency of their application, selecting a specialist of the appropriate profile, formulating tasks for him, as well as planning the forms and methods of his participation in the investigative action. Special attention is paid to the need for preliminary consultations with specialists on the features of detecting, fixing and seizing individual objects, using special technical means and ensuring proper preparation for conducting a procedural action. The features of using special knowledge at the working stage of conducting investigative (search) actions are also analyzed. It is noted that their subjects can be an investigator, prosecutor, specialists, as well as other participants in criminal proceedings, whose involvement is provided for by criminal procedural legislation. The role of a specialist in ensuring effective search and fixing of traces, using special technical means, preliminary assessment of objects, as well as providing consultations or references within the limits of his competence is emphasized. It is concluded that the correct organization of interaction between the investigator, prosecutor and specialist, as well as the justified application of special knowledge at different stages of investigative (search) actions, contributes to increasing the efficiency of the pre-trial investigation and a more complete establishment of the circumstances of the criminal offense.
