EXPERIENCE OF GEORGIA REGARDING ADMINISTRATIVE AND LEGAL ENSURING THE RIGHTS, FREEDOMS AND LEGAL INTERESTS OF CITIZENS IN THE CONDITIONS OF WARS AND MILITARY CONFLICTS

Abstract

The article reveals the positive experience of Georgia regarding the administrative and legal support of the rights, freedoms, and legitimate interests of citizens in conditions of wars and military conflicts. It is highlighted that Georgia has an instructive and successful experience for Ukraine in the legislative and administrative-legal regulation of the protection of the housing rights of displaced persons. Legislative provisions, regulatory and executive activities of Georgian administrative bodies are aimed at providing adequate housing for temporarily displaced persons and their integration into society. The state strategy regarding internally displaced persons and the Action Plan for its implementation were last adopted by the government in 2007 and updated in 2008 following the Russian aggression. These documents are based on the priorities set by the UN and the World Bank, as well as on an effective analysis of the needs of internally displaced persons. According to Georgian legislation, displaced persons are provided with long-term housing and are not subject to eviction from residential premises that do not belong to them by right of ownership. Furthermore, it is specified that the housing area legally occupied by a displaced person must be safe, healthy, and sanitary. Competent administrative bodies must ensure that every internally displaced person has adequate housing, i.e., living in safe conditions. Significant state and donor funds are allocated to improve the living conditions of displaced persons. This ensures the reconstruction of existing premises, resettlement of owners into their newly built houses funded by public money, and stimulation of their relocation to developing regions of Georgia. For the implementation of these projects, both state finances and local development funds were used, along with support from international humanitarian agencies and European Union programs. The measures are aimed at stabilizing and integrating the displaced population and serve as an example of effectively addressing issues related to the protection of housing rights in the context of conflict and displacement.
